Terms of Service

These Terms of Service ("Terms") govern your access to and use of Oculta AI, a desktop application provided by Fuet Corp. ("Fuet", "we", "us", or "our"). By installing, accessing, or using Oculta AI (the "App"), you agree to these Terms. If you do not agree, do not install or use the App.

Oculta AI is a product of Fuet Corp.

1. Definitions

• "App" means the Oculta AI desktop software, including all updates and related online services.
• "User Content" means any audio, screenshots, transcripts, or other data you record or generate through the App.
• "Subscription" means your paid access to premium features of the App under a Free, Basic, Premium, or Unlimited plan.

2. License Grant and Restrictions

2.1 License. Subject to these Terms and payment of applicable fees, Fuet grants you a non-exclusive, non-transferable, revocable license to install and use the App on your personal device.

2.2 Restrictions. You may not:

• Reverse engineer, decompile, or modify the App.
• Remove or alter any proprietary notices.
• Distribute, sublicense, or lease the App.
• Use the App in violation of any applicable law (including laws governing recording or monitoring of communications).
• Use automated means to access or interfere with the App.

3. Account and Subscriptions

3.1 Account Setup. To use any feature beyond the free trial, you must register an account via Supabase Auth, providing a valid email and a secure password.

3.2 Subscription Plans. Details of our Free, Basic, Premium, and Unlimited plans are available at oculta.ai/pricing.

3.3 Billing. All subscription fees are processed directly through Stripe. Subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before renewal.

4. Payment, Cancellation, and Refunds

4.1 Payment. You authorize us to charge your payment method stored in Stripe.

4.2 Cancellation. You may cancel or downgrade at any time in your account settings; changes take effect at the end of your current billing period.

4.3 Refunds.

• 24-Hour Guarantee: If the App does not function as advertised, email info@oculta.ai within 24 hours of purchase with evidence, and we will issue a full refund.
• Prorated Refunds: Not offered.

5. User Content and Privacy

5.1 Recording and Processing. Screen recordings and audio processing happen locally or via secure API calls. We send data to Gemini API (and other supported models) solely to generate responses. We do not store recordings, transcripts, or metadata without your consent.

5.2 Security. We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your data against unauthorized access, disclosure, or destruction.

6. Intellectual Property

All rights, title, and interest in the App and its content are owned by Fuet or its licensors. No rights are granted other than those expressly set forth in these Terms.

7. Disclaimers and Limitation of Liability

7.1 No Warranty. The App is provided "as is" and "as available," without warranty of any kind.

7.2 Limitation of Liability. Fuet's total liability under these Terms shall be $0.

7.3 Special Disclaimer. In no event shall Fuet be liable for damages arising from the use of the App, including loss of employment, cancelled interviews, financial or reputational damage.

8. Indemnification

You agree to indemnify and hold Fuet harmless from any claims arising from your misuse of the App, breach of these Terms, or violation of law.

9. Termination

We may terminate or suspend your access for breach of these Terms or non-payment. Upon termination, your license concludes and any unpaid fees become due.

10. Dispute Resolution

All disputes shall be resolved by binding arbitration in Delaware under JAMS Streamlined Arbitration Rules. You and Fuet waive any right to a jury trial or class action.

11. Changes to Terms

We may update these Terms by notifying you via email and posting a new version. Continued use after changes constitutes acceptance.
